1. Acceptance of Terms

By accessing or using EnjoyPrices ("the Platform", "we", "us", "our") at enjoyprices.com, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using the Platform.

2. Description of Service

EnjoyPrices is a peer-to-peer digital marketplace that facilitates the buying and selling of in-game items, virtual currencies, gift cards, top-ups, and gaming services ("Digital Goods"). We act solely as an intermediary between buyers and sellers and are not a party to any transaction.

3. Eligibility

There is no minimum age requirement to create an account and browse or purchase Digital Goods as a buyer.

To become a seller, you must be at least 18 years of age and be able to provide valid government-issued ID during the seller verification process. By applying as a seller, you confirm that you are 18 or older and that all information you submit is accurate and complete.

4. Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• Usernames may only contain letters, numbers, and underscores (3–20 characters). You may change your username once every 30 days.
• We reserve the right to suspend or permanently ban accounts that violate these terms.
• Account sharing or selling is strictly prohibited.

5. Nature of Transactions — Real Money Trading Disclaimer

All transactions facilitated through EnjoyPrices represent compensation for the time, labor, and effort a seller has personally invested in acquiring, developing, or providing the relevant Digital Goods or services. No transaction on this Platform constitutes the sale, transfer, or assignment of any intellectual property rights owned by a game publisher, developer, or other rights holder.

By using the Platform, buyers and sellers acknowledge that:

• Game publishers retain full ownership of all in-game assets, virtual currencies, and account data at all times.
• The exchange of funds on EnjoyPrices compensates sellers exclusively for their personal time and effort, not for any claimed ownership of publisher intellectual property.
• Trading certain Digital Goods may violate the terms of service of individual game publishers. EnjoyPrices does not condone violations of publisher terms and bears no liability for any consequences arising from such violations, including account bans issued by the publisher.
• EnjoyPrices is not affiliated with, endorsed by, or authorized by any game publisher whose content may appear on the Platform.

6. Seller Obligations

Sellers must complete our identity verification process before listing Digital Goods. By listing on EnjoyPrices, sellers agree to:

• Only list Digital Goods for which they are the original creator or an authorized user, and for which they are trading compensation for the personal time and effort invested in obtaining or providing those goods.
• Accurately describe all listings, including stock, delivery time, and applicable terms.
• Fulfill orders within the stated delivery window.
• Not engage in price manipulation, fake reviews, or fraudulent activity.
• Accept that a platform fee (set per game category) is deducted from each completed sale.

7. Buyer Obligations

• Buyers must provide accurate payment information.
• Chargebacks or payment reversals initiated in bad faith may result in a permanent ban and legal action.
• Buyers must not attempt to circumvent the Platform by transacting with sellers off-platform.
• Reviews must be honest, accurate, and at least 20 characters. Fake or retaliatory reviews are prohibited.

8. Payments and Fees

• All prices are displayed in USD.
• We accept payment via credit/debit card (Stripe), cryptocurrency (NOWPayments), and internal wallet balance.
• Platform fees are deducted from seller payouts when an order is marked complete; the buyer always pays the full listed price.
• Minimum withdrawal amount is $10. Withdrawal fees apply: USDC 6% + $10, Payoneer 4% + $10, Bank Transfer 4% + $10.
• We reserve the right to modify fee structures with 7 days' notice.

9. Dormant Accounts

To avoid the burden of state escheatment laws, which require platforms to remit abandoned funds to the government, EnjoyPrices implements the following dormant account policy:

• An account is considered dormant if there has been no login, order, listing activity, or withdrawal for a continuous period of 12 months.
• A $5.00 USD monthly inactivity fee will be deducted from any internal wallet balance remaining on a dormant account. This fee is charged once per calendar month for each month the account remains dormant.
• The inactivity fee will not cause your wallet balance to go below $0.00. Deductions stop once the balance reaches zero.
• We will make reasonable efforts to notify you by email before the inactivity fee begins and on the first deduction.
• You may reactivate your account and stop further fees at any time by logging in and completing any account activity.
• Accounts with a $0.00 balance are not subject to this fee.

10. Disputes and Refunds

Buyers may open a dispute on any order that has not yet been marked complete. EnjoyPrices admin will review evidence from both parties and issue a binding decision. We reserve the right to:

• Issue a full or partial refund to the buyer.
• Release funds to the seller.
• Split the order amount between buyer and seller.

Refunds for completed orders are at our sole discretion and are not guaranteed.

11. Prohibited Content and Conduct

The following are strictly prohibited on EnjoyPrices:

• Listing, selling, or buying stolen, hacked, or compromised accounts, keys, or items.
• Selling cheats, hacks, exploits, or software that violates a game publisher's terms of service.
• Harassment, threats, hate speech, or abusive communication with other users.
• Impersonating EnjoyPrices staff, other users, or any third party.
• Using bots, scrapers, or automated tools to interact with the Platform.
• Money laundering or using the Platform for any illegal financial activity.

12. Intellectual Property

All Platform content, including logos, design, and code, is the intellectual property of EnjoyPrices. Game names, logos, and trademarks referenced on the Platform belong to their respective owners. EnjoyPrices is not affiliated with any game publisher unless expressly stated.

13. Limitation of Liability

EnjoyPrices is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform, including losses due to seller non-delivery, account bans by game publishers, or payment processor issues. Our total liability to you for any claim shall not exceed the amount you paid to us in the 90 days preceding the claim.

14. Termination

We reserve the right to terminate or suspend your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may delete your account at any time by contacting support.

15. Changes to Terms

We may update these Terms at any time. Continued use of the Platform after changes are posted constitutes your acceptance of the new Terms. We will make reasonable efforts to notify users of material changes.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which EnjoyPrices is registered, without regard to conflict-of-law principles. Subject to the arbitration clause in Section 17 below, any dispute that proceeds to court shall be brought exclusively in the courts of that jurisdiction, and you consent to the personal jurisdiction of those courts.

17. Binding Arbitration & Class Action Waiver

Please read this section carefully. It affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to these Terms, the Platform, or any transaction facilitated through EnjoyPrices ("Dispute") shall be resolved exclusively through final and binding individual arbitration, rather than in court, except that you may assert individual claims in small claims court if they qualify.

Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration will be conducted in English. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver: You and EnjoyPrices each agree that any Dispute must be brought in your respective individual capacities, and not as a plaintiff or class member in any purported class, collective, representative, or private attorney general action. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of class or representative proceeding.

Class-Wide Arbitration Waiver: You agree that you may not bring any Dispute as a class-wide arbitration proceeding, and that the arbitrator has no authority to conduct class-wide arbitration.

If the class action waiver in this section is found unenforceable with respect to any Dispute, then the entirety of this arbitration provision shall be null and void for that Dispute only, and it shall be resolved in a court of competent jurisdiction. All other Disputes shall continue to be resolved through individual arbitration as set forth herein.
