DMCA Notice & Takedown Policy

Overview

EnjoyPrices respects the intellectual property rights of others and expects users of the Platform to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement committed using the Platform.

Reporting Copyright Infringement

If you believe that content available on EnjoyPrices infringes your copyright, please submit a written DMCA notice to our Designated Copyright Agent containing all of the following elements required by 17 U.S.C. § 512(c)(3):

1. Identification of the copyrighted work — A description of the copyrighted work you claim has been infringed, or if multiple works are covered, a representative list of such works.
2. Identification of the infringing material — A description of the material you claim is infringing and information reasonably sufficient for us to locate it on the Platform (e.g., the URL of the listing or page).
3. Your contact information — Your full name, mailing address, telephone number, and email address.
4. Good faith statement — A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
5. Accuracy statement — A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.
6. Physical or electronic signature — A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Notice Format — Plain Text Required

All required information listed above must be included in the body of your email. Do not reference or "attach supporting documents" — paste the relevant text and URLs directly into your message.

Designated Copyright Agent

Our Response Process

Upon receipt of a valid DMCA notice, EnjoyPrices will:

• Remove or disable access to the allegedly infringing content promptly.
• Notify the user who posted the content that it has been removed.
• Provide the user with an opportunity to submit a counter-notification.
• Forward any valid counter-notification to the original complainant.

Counter-Notification

If you believe your content was removed in error, you may submit a counter-notification under 17 U.S.C. § 512(g)(3) to our Copyright Agent. Your counter-notification must include:

1. Your physical or electronic signature.
2. Identification of the removed content and its location before removal.
3. A statement under penalty of perjury that you have a good faith belief the content was removed by mistake or misidentification.
4. Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the applicable federal court.

If we receive a valid counter-notification, we may restore the content after 10–14 business days unless the original complainant files a court action.

International Intellectual Property Claims

While this policy is written with reference to the U.S. DMCA, EnjoyPrices applies the same notice-and-takedown procedures to international intellectual property claims, including those made under:

• EU Digital Services Act (DSA) — Rights holders based in the European Union may submit notices of allegedly illegal content under the DSA using the same contact and format requirements described above.
• Other jurisdictions — We will consider valid takedown requests submitted under the applicable IP laws of any jurisdiction, provided the notice contains the substantive information listed in this policy.

Submitting a notice under international law does not exempt the claimant from the plain-text-only requirement described above.

Repeat Infringers

EnjoyPrices has a policy of terminating the accounts of users who are determined to be repeat infringers of copyright. We will permanently ban any user who repeatedly infringes the intellectual property rights of others.

False Notices

Be aware that under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be subject to liability for damages, including costs and attorneys' fees.

Trademark Concerns

If you believe content on EnjoyPrices infringes your trademark rights rather than copyright, please contact us at [email protected] with details of the alleged infringement. Trademark claims are handled separately from DMCA copyright claims.

Game Publisher Notice

Game names, logos, and in-game assets referenced on EnjoyPrices are trademarks and intellectual property of their respective publishers. EnjoyPrices is not affiliated with, endorsed by, or sponsored by any game publisher unless expressly stated.
